Belmont Mold Removal Runs on the Notification Calendar

The honest answer about timing in a 1938 Belmont house is that the paperwork starts this week and the demolition starts after it.

Four quick questions, then your details. It takes about twenty seconds.

Question 1What are you dealing with?
Question 2Is anything still wet?

Massachusetts gives an owner 48 hours to get wet surfaces dry after a leak, and the EPA puts mold growth in the same window, so this answer sets the pace of everything else.

Question 3What is your position at the property?

Most homes in Cambridge are rented, and who holds the duty to fix dampness changes who we talk to and what has to be written down.

Question 4How soon do you want someone out?
Who you are, and which building

Who should we ask for?

How can we reach you?

We call to confirm the details before anyone is sent out.

Where is the property?

The contractor match is by property, not by person, so the street line matters.

Deciding

Using the Belmont notification period instead of losing it

So weigh what can be done inside those two weeks, because plenty can. The water source can be fixed, the room can be dried, contents can be moved and the containment can be built, which puts demolition day at the end of the sequence rather than the start of it. Weigh the contract as well: the Residential Contractor's Guaranty Fund compensates an owner for work a court or arbitrator finds was done in a poor or unworkmanlike manner where the contractor has not paid, and it reaches pre-existing owner-occupied buildings of one to four units, which most of this town is. Do not pull the permit yourself to save a fee, because that forfeits it.

  1. What happens during the ten days

Source repair, drying, contents out, containment built. The wall opens last, which is also when the dust and the disruption arrive.

  2. Owner-occupied means the Fund is real here

Most of Belmont is a one to four unit building the owner lives in, which is exactly the case MGL c.142A reaches. That protection is worth keeping.

  3. Never secure the permit yourself

MGL c.142A s.2 excludes a homeowner who pulls their own permits from the Guaranty Fund. It is the cheapest mistake available and it is not reversible.

Belmont's build years and the asbestos notice rule

Additional Cambridge-area building moisture context

Belmont has 57.1 percent of its housing units built in 1939 or earlier and a median year of construction of 1938, with 87.3 percent built before 1980. 45.4 percent of its units are single-family detached and 29.7 percent sit in two-unit structures.

310 CMR 7.15(6)(a) requires a completed asbestos notification form and any applicable fee to be received by the Massachusetts Department of Environmental Protection at least ten working days before asbestos abatement begins, and a working day is any day the Department is open for business.

MGL Chapter 142A Section 5 establishes the Residential Contractor's Guaranty Fund to compensate owners for actual losses caused by a registered contractor's work found by a court or arbitrator to have been performed in a poor or unworkmanlike manner, where the contractor has failed to pay the judgment or award. Two limits are written into the chapter: Section 1 confines it to a pre-existing owner occupied building of one to four dwelling units, so an owner of a rented two or three family house cannot claim on it, and Section 2 excludes from the Fund any homeowner who secures their own permits.

MGL Chapter 142A Section 2 requires a residential contract to inform the homeowner that any necessary permits are the contractor's obligation to obtain, and that HOMEOWNERS WHO SECURE THEIR OWN PERMITS WILL BE EXCLUDED FROM THE GUARANTY FUND PROVISIONS of the chapter. Pulling your own permit therefore forfeits the Residential Contractor's Guaranty Fund for that job.

What mold removal involves in Belmont

Local Context

Ten working days is two calendar weeks

With 87.3 percent of Belmont housing built before 1980 and a median build year of 1938, almost every removal in this town is a pre-1978 building with a documentation gate in front of it. 310 CMR 7.15(4) requires an asbestos inspector and a written survey report before any renovation that will breach suspect asbestos-containing material, and where abatement follows, 7.15(6)(a) requires the notification form to have been received by MassDEP at least ten working days before it begins, counting only days the department is open. Ten working days is two calendar weeks. Anyone promising to open a Belmont wall next Tuesday is either not surveying or not notifying.

Questions

What Belmont owners ask about the removal schedule

Two weeks feels like forever. Can it be done faster?

Only where the work breaches no suspect material at all, which does happen and is worth checking first. Where abatement is needed the ten working day notice is a statutory minimum and nobody can shorten it, so the fast version of this job is starting the survey today rather than negotiating the calendar.

Is the Guaranty Fund actually any use to me?

If you live in the one to four unit building and the contractor is registered, yes: it exists to compensate you for work found to be poor or unworkmanlike where the contractor has not paid the award. Two things remove it, not living there and securing your own permits, and only one of those is under your control.
